How to Cancel a Commercial Waste Contract (Republic, WM and Others) Without Paying a Penalty

Most commercial trash contracts auto-renew and charge months of fees to leave early. Here's how to find your cancellation window and get out cleanly.

If you've ever tried to cancel commercial trash service, you probably heard some version of "you're under contract until 2029." That's not a sales tactic. It's how most hauler agreements are written. The good news: every one of them has a way out. You just have to know where it is and act at the right time.

Why your contract keeps renewing

Almost every commercial service agreement from the large national haulers includes an automatic renewal clause. When the initial term ends, the agreement rolls into a new term at the then-current rates unless one side gives written notice in time.

  • WM's published commercial terms say the agreement automatically renews, and that notice to cancel a renewal term of 12 months or more must arrive at least 90 days but no more than 180 days before the term ends. Notice outside that window doesn't count.
  • Republic's published commercial terms (Sacramento version) renew for successive 12-month terms unless either party gives written notice at least 30 days before the end of the current term.
  • Initial terms are often 36 to 60 months. The exact length is on your service summary or the first page of your agreement.

These are each company's published standard terms. Your signed agreement can be different, so always check the copy you actually signed.

What it costs to leave early

Cancel outside the window and you'll usually owe liquidated damages, a pre-agreed early termination fee. The published formulas are similar:

Hauler (published terms)Typical early termination fee
WMAverage of your last 6 monthly charges × 6, or × the months left if fewer than 6 remain
Republic (Sacramento terms)Average of your last 6 invoices × the lesser of 6 months (initial term), 3 months (renewal term), or the months remaining

On a $900-a-month account, six months of fees is $5,400. That's why timing matters more than anything else in this process.

Step by step: how to cancel cleanly

  1. Get a copy of your signed agreement. If you can't find it, ask your hauler in writing for a copy of your current service agreement and service summary. You're entitled to see what you signed.
  2. Find three things: the start date, the term length, and the renewal and cancellation language. Calculate the end date of the current term.
  3. Mark your window on a calendar. If the notice period is 90 to 180 days before the end date, that's your window. Set a reminder at the start of it.
  4. Line up your next provider before you send notice, so there's no gap in service.
  5. Send written notice the way the contract requires (some specify certified mail or a specific address). Keep a copy and the delivery receipt.
  6. Ask for written confirmation of the cancellation and your final service date.
  7. Schedule container removal for your final day and check your last invoice for any surprise fees.

What if you're outside the window?

  • Check whether your hauler has raised your rates. Some agreements let you cancel within a set number of days after a price increase notice, and consent is often assumed if you keep paying without objecting.
  • Look for service failures. Repeated missed pickups can be a material breach, and most agreements allow termination for uncured breach after written notice.
  • Run the math. Sometimes paying a termination fee still saves money if the new rate is far lower over the next few years.
  • If none of that works, mark the next window and start the clock now so you don't miss it again.
